Who decides these days
Brazil's national holidays sit in permanent statutes, such as Law 662 of 1949 and Law 14,759 of 2023.
On top of them comes a yearly ministerial ordinance (Portaria MGI) that announces those holidays and designates ponto facultativo — days the federal administration may take off, binding on no private employer.
Carnival Monday and Tuesday are of that kind.The ordinance even carries unnamed bridging days and half-days fixed by the clock.
One day's legal standing is genuinely unsettled: Good Friday (Sexta-feira Santa) is printed in the national-holiday column of the MGI's annual table, yet Article 2 of Law 9,093/1995 files it under religious holidays — declared by municipal law, at most four per municipality, with Good Friday named as one of those four.
On the table it is national; in the statute it is municipal, and both texts stand.
