Who decides these days

Vietnam's public holidays are set by Article 112 of the 2019 Labour Code: New Year's Day, five days of Tết, the Hùng Kings' Commemoration (10th day of the third lunar month), Reunification Day on 30 April, Labour Day on 1 May, and National Day on 2 September plus one adjacent day, 11 days in all.

National Assembly Resolution 28/2026/QH16 added Vietnamese Culture Day on 24 November from July 2026, making 12.

The law fixes only the number of days.

Which five days Tết covers, and whether National Day is paired with 1 or 3 September, is set each year by the Ministry of Home Affairs with the Prime Minister's approval, usually the autumn before; for 2026 it was Notice 9441/TB-BNV.

The notice binds civil servants.

Private employers may arrange the days differently within the rules but must tell staff 30 days ahead.

The long breaks in the news usually come from swapping a weekday for a working Saturday, which adds no leave.

Tết follows Vietnam's own lunar calendar, computed for UTC+7, which can differ from the Chinese one by a day.
